1. Applicability and Scope

This Privacy Policy covers Teradact’s customer-facing operations and applies to the personal information Teradact obtains in various contexts, both online and offline, including when you access or use our family of websites, and any of their related products and services (the “Related Services”, and collectively with each website or service, the “Services”).

Our websites may include links to websites and/or applications operated and maintained by third parties. Please note that we have no control over the privacy practices of websites or applications that we do not own. We encourage you to review the privacy practices of those third parties.

2. What Personal Information We Collect

The types of personal information we obtain about you depends on how you interact with us and our products and services. When we use the term “personal information,” we are referring to information that identifies, relates to, describes, or can be associated with you. The following are the categories and specific types of personal information that we collect:

Including your full name, e-mail address, phone number. 

Internet or Other Electronic Network Activity Information

Including  browsing or search history, device identifier, internet protocol (IP) address, cookies, beacons, pixel tags, mobile ad identifier, or similar unique identifiers.

3. How We Collect Your Personal Information

We collect personal information about you from various sources. For example, we collect and obtain information: Directly from you (i.e., when you submit information through our “Contact Us”) and automatically when you use our Services i.e., We also collect personal information through automated means such as the use of cookies, or capture of device information such as IP address, browser type, and log file from user sessions. Although we are not currently collecting personal information from vendors, suppliers, business partners, social media, data analytic partners we are exploring possible engagements but only for permitted business purposes. When we do so, we will update this Privacy Policy accordingly. 

4. How We Use Your Personal Information

We collect and use personal information for various purposes, including:

Provide Products and Services

We use your personal information to provide products and services, such as to fulfill your orders and/or complete the transactions you request; to process your payments; to provide you receipts and order updates; and to send notifications to you related to your account, purchases, returns, exchanges, subscriptions, and reservations.

We use your personal information to communicate with you, such as to respond to and/or follow up on your requests, inquiries, issues, or feedback, and to provide customer service.

We use personal information to comply with our legal or regulatory obligations, to establish or exercise our rights, and to defend against a legal claim.

  • The processing is necessary for us to provide you with the services and products you request, including to respond to your inquiries. 
  • We have a legal obligation to process your personal information or to protect your vital interests, or those of others. 
  • We have a legitimate interest in processing your personal information, including to maintain and operate our websites, monitor and improve the safety and security of our websites, provide you with tailored marketing to develop and promote our business, and anonymize personal information.
5. How We Disclose Your Personal Information

In addition to the specific situations discussed elsewhere in this Privacy Policy, we disclose personal information in the following circumstances:

Service Providers

We disclose personal information to service providers that perform services to support our business functions and internal operations including: sending postal mail, e-mails, and text messages; analyzing customer data; providing marketing assistance; investigating fraudulent activity; and providing customer service.

 

Affiliates and Business Partners

We disclose personal information to our affiliates and business partners to help manage and operate our business, as part of our regular reporting activities, in the event of a business reorganization or restructuring, and in connection with the operation of group-wide functions and services.

Legal Process

We may disclose personal information in response to subpoenas, warrants, court orders, government inquiries, or investigations; or to comply with relevant laws and regulations. Transfer of Control / Merger or Acquisition

We may disclose personal information with another company that buys some, or all, of the assets or stock of Teradact, and that company may use and disclose personal information for purposes similar to what is described in this policy. Teradact may also disclose personal information with prospective purchasers to evaluate the proposed transaction.

6. How We Protect Your Personal Information

We maintain reasonable and appropriate physical, electronic, and procedural safeguards designed to help protect your personal information. While we attempt to protect your personal information in our possession, no method of transmission over the internet or security system is perfect, and we cannot promise that information about you will remain secure in all circumstances.

7. Cookies, Tracking Technologies, and “Do Not Track” Signals 

We, and our third-party partners, may automatically collect certain types of usage information when you visit our websites or use our Services. We may collect this information through a variety of tracking technologies, including cookies, web beacons, embedded scripts, location-identifying technologies, file information, and similar technology (collectively, “cookies”). Consistent with applicable law, you may exercise the rights described in this section. Please note that some of the rights may vary depending on your country, province, or state of residence.

The Right to Accessing, Correcting, and Deleting Personal Information

You may have the right to request access to, get a copy of, and receive details about the personal information we maintain about you, how and why we have processed it, which sources we have collected it, which parties we have disclosed it, and whether we have sold or shared it.  You may also have the right to correct inaccuracies or delete your personal information. 

 

The Right to Opt Out of Sale/Share of Personal Information 

We do not sell your personal information for money. However, we are disclosing a very limited category of your personal information including: (1) Basic Identifiers and (2) Internet or Other Electronic Network Activity Information, by allowing certain third parties to collect personal information via automated technologies on our websites for cross-context behavioral advertising purposes or other advertising, marketing, or analytics purposes only. Under certain applicable laws, these kinds of disclosures may be considered a “sale” when the personal information is exchanged for valuable consideration, or “sharing” when the personal information is disclosed for cross-context behavioral advertising purposes. 

You can also opt-out of the sale/share of your personal information by submitting a request via the “Do Not Sell My Personal Information” link at the bottom of our website. Additionally, in certain jurisdictions, you may opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). The Right to Limit the Use of Sensitive Personal Information

Currently, we do not collect or use any sensitive personal information. For this reason, we do not offer a way for you to submit such a request.

 

The Right to Related to Automated Decision-Making 

Currently, we do not use automated decision-making, including profiling, to evaluate certain personal aspects relating to your consumer behavior, interests, preferences, and the use of our Services. For this reason, we do not offer a way for you to submit such a request.

Please note that, depending on the nature of your request, you may be asked to provide information to verify your identity before your request can be processed. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed.

Right to Appeal Decision

Depending on your residency, you may have the right to appeal our decision. If you would like to submit an appeal about our decision to your request regarding your personal information, you may email us at [email protected].  We respond to all appeal requests as soon as we reasonably can and no later than legally required.

Right to Non-Discrimination for the Exercise of Your Privacy Rights 

If you choose to exercise any of the privacy rights described above, we will not discriminate against you. This means that, consistent with applicable state privacy law, we will not deny providing our products or services to you, charge you different prices, or provide a different level or quality of products or services to you unless those differences are related to the value of your personal information.

9. Retention of Your Personal Information

Typically, we retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. Please note that in many situations we must retain all, or a portion, of your personal information to comply with our legal obligations; resolve disputes; enforce our agreements; protect against fraudulent, deceptive, or illegal activity; or for another one of our business purposes.  Unless otherwise required by law, at the end of the retention period we will remove or anonymize personal information.

10. Transmission of Information to Other Countries

Teradact is located in the United States.

If you submit personal information to us, your personal information may be processed in a foreign country, where privacy laws may be less stringent than the laws in your country. By submitting your personal information to us you agree to the transfer, storage, and processing of your personal information in a country other than your country of residence including, but not necessarily limited to, the United States. Our websites are not intended for or directed to children under the age of 13. We do not knowingly collect personal information directly from children under the age of 13 without parental consent. If we become aware that a child under the age of 13 has provided us with personal information, we will delete the information from our records.

California law requires us to disclose the following additional information with respect to our privacy practices. If you are a California resident, this section applies to you in addition to the rest of the Privacy Policy.

California “Shine the Light” Law

Under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), California residents who provide us certain personal information are entitled to request and obtain from us, free of charge, information about the personal information (if any) we have shared with third parties for their own direct marketing use. Such requests may be made once per calendar year for information about any relevant third party sharing in the prior calendar year.
